Water Slide Rental Agreement and Release of Liability
RENTAL AGREEMENT
Payment policy:
A nonrefundable $50 deposit is due once your booking is accepted. This deposit will be applied to the total price. The remaining full payment is due 24 hours prior to the event. Failure to make the full payment on time could result in cancellation. The rental will not be delivered without full payment in advance. Payment options include:

Weather Policy
We reserve the right to cancel any reservations due to severe or imminent deterioration of weather conditions. You will receive a full refund if we cancel due to weather.
There will be no refunds or reductions in price due to foul weather after 7:00 a.m. the day of drop off.
Cancellation Policy
Cancellations must be done 24hrs before reservations. If there is bad weather the day of your party, you have until 7 a.m. the morning of to receive a full refund.
If there are any issues with the unit it is the renter’s responsibility to let TKO Splashbash know as soon as the issue arises. For example, if the blower is not working, there is a large tear (remember every seam lets out air so if you feel air that does not mean there is a problem)
We cannot fix something if we don't know about it!
Responsible Party
With my signature and return of this form, I acknowledge my receipt and understanding of the rules, waiver of liability form, and weather procedures. I also acknowledge that accidents may occur in a water slide or other unit that may range from mild bumps and bruises to broken bones or worse and that TKO Splashbash and their staff are not responsible. A responsible adult is to always supervise the water slide usage and ensure that children and other adults follow and respect the rules for usage. If TKO Splashbash provides staff, they are there to try and enforce rules and make sure that units are used appropriately. This is not a guarantee that children will follow the rules or that no accidents will occur. Any injuries will first be turned into the homeowners, church, or community organization's homeowners or general liability policy.
RELEASE OF LIABILITY
In order to participate in TKO Splashbash events, I on my own behalf, or on the behalf of the participant(s) that I am responsible for, acknowledge, appreciate, and agree to the following conditions:
1.) I will ensure that the participants will follow all verbal and written rules and directives required for participation in all TKO Splashbash. I am responsible for children at our events compliance with the rules.
2.) If I observe any hazards during our participation I will fix them.
3.) I am aware that participation in events at TKO Splashbash, using inflatable units poses a risk of injury and I, on behalf of myself and all participant(s) freely accept all risks, both known and unknown, even if arising from the negligence of others. I, for myself and all participants, and our respective heirs, representatives, next of kin hereby hold harmless all staff, owners, and volunteers of TKO Splashbash as well as other participants, and sponsoring agencies or individuals from and against all claims, injuries, liabilities, or damages arising out of or related to participation in activities, parties, or use of TKO Splashbash equipment or facilities.
Lessee shall pay for theft and/or damage of the inflatable while on their premises. Lessor (TKO Splashbash) and its officers, employees and agents is/are not responsible for any injury occurring to any person or persons in contact with the water slide and/or other rental equipment.
I agree to indemnify and hold harmless TKO Splashbash, their agents, employees, directors, and subcontractors from any claims, damages, losses, injuries and expenses arising out of or resulting from participation in these activities. I further agree to release, acquit and covenant not to sue TKO Splashbash, their agents, employees, directors, boards, subcontractors, and volunteers for all actions, causes of action claims or damages, damages in law or remedies in equity of whatever kind, including the negligence of TKO Splashbash, its directors, employees, agents, boards, volunteers, subcontractors, or my family, myself, or my heirs, against TKO Splashbash, its directors, employees, agents, boards, volunteers, subcontractors, or their heirs arising out of participation in this program.
As liquidated damages, I hereby agree that if TKO Splashbash, their agents, employees, directors, boards, subcontractors, and volunteers is forced to defend any action, lawsuit, or litigation by myself, my executors, or my heirs, on my family’s behalf, my heirs or executors and I agree to pay TKO Splashbash, their agents, employees, directors, boards, subcontractors and volunteers costs and attorney fees to defend such action, lawsuit or litigation.
In short, TKO Splashbash its directors, agents, boards, volunteers, subcontractors, or their heirs, cannot be sued, and if any lawsuit is held no-one can collect any money or other securities and properties.
I have read and understood ALL of the Rules listed above AND the Release of Liability and agree to abide by those rules and that TKO Splashbash will be held harmless against any claims due to injury or other as described above.
